A BARANGAY ORDINANCE ON IMPLEMENTING THE NATIONAL IMMUNIZATION PROGRAM IN THE BARANGAY NABA, CULASI, ANTIQUE AND APPROPRIATING FUNDS THEREFOR AND OTHER PURPOSES
WHEREAS, Republic Act 7160, otherwise known as the Local Government Code of 1991, mandates the devolution of the delivery of health services and facilities to the Local Government Unit(LGUs) at all levels;
WHEREAS, adopting an Ordinance No. 2024-267 entitled; An Ordinance adopting Republic act No. 101521 otherwise known as “Mandatory Infants and Children Immunization Act of 2011 in the municipality of Culasi Antique:
WHEREAS, “UNIVERSAL HEALTH CARE”, also known as “Kalusugan Pangkalahatan” of better health outcomes, more responsive health systems and equitable health care financing and particularly seeks to protect children from deaths and infirmities due to common vaccine-preventable disease;
WHEREAS, Article II, Section 4 of the 1987 Philippine Constitution States that it is the prime duty of the government to serve and protect the people and instill health consciousness among them;
WHEREAS, Article XV, Section 3 of the 1987 Philippine Constitution declares that the State shall defend the right of the children to assistance, including proper care and nutrition;
WHEREAS, Article XIII, Section II of the 1987 Philippine Constitution states that the State shall adopt an integrated and comprehensive approach to health development, which shall endeavor to make essential goods, health, and social services available to all the people at affordable cost; there shall be priority for the needs of the underprivileged, sick, elderly, disabled, women and children;
WHEREAS, the Barangay Naba, Culasi, Antique pursues a comprehensive healthcare approach with emphasis on preventive health care services by adhering to Republic Act 10152 otherwise known as the Mandatory Infants and Children Health Immunization Act;
WHEREAS, Immunization is a key component of primary health care, critical to the prevention and control of infectious diseases outbreaks and prevent life- threatening disease; and this Ordinance is enacted to strengthen the implementation of the National Immunization Program to ensure the health and well- being of the constituents.
NOW, THEREFORE, upon recommendation of Punong Barangay, HON. GREGORIO T. CALITANG II, duly seconded by Sangguniang Barangay Member, HON. OFELIA O. BANDIOLA.
BE IT ORDAINED BY THE SANGGUNIANG BARANGAY IN SESSION ASSEMBLED THAT:
ARTICLE I
Title of the Ordinance
This Ordinance shall be known as an Ordinance Implementing the National Immunization Program (NIP) in the Barangay Naba, Culasi, Antique, providing appropriation thereof, and for the purpose, otherwise known as the “Barangay Naba Mandatory Immunization Program Ordinance”.
ARTICLE II
Coverage
This Ordinance shall apply to all residing, and transient mothers, children, and senior citizens of Barangay Naba of the Municipality of Culasi, Province of Antique and extends to the eligible citizens given that proper reporting and immunization documents is presented. All target populations for the immunization program shall receive recommended immunization by the Department of Health against vaccine- preventable diseases and such other types as may be determined by the Secretary of Health in a department circular or by the Municipal Health Officer, as follows:
A. Infants and Children:
1. BCG - upon birth
2. Hepatitis B - upon birth
3. Pentavalent Vaccine (Diptheria, Pertussis, Influenza, Tetanus, Hepatitis B)
4. Pneumonia Conjugate Vaccine
5. Oral Polio Vaccine
6. Measles, Mumps and Rubella Vaccine (MMR)
7. Meningococcal Vaccine (MCV) - 1-9 Months
8. Meningococcal Vaccine (MCV) - 2-12 Months
9. Human Papilloma Virus (HPV)
B. Senior Citizens:
1. Anti- flu Vaccine
2. Anti- Pneumonia Vaccine
C. Pregnant Women:
1. Tetanus, Diphtheria and other vaccines as recommended
All infants and children shall receive the mandatory basic immunization for free at the Barangay Health Center/Station, Rural Health Unit, other government health facilities and other designated appropriate areas for infants and children up to 5 years old of age.
ARTICLE III
Authority, Purpose, and Goals
SECTION I. AUTHORITY. This Ordinance enacted to implement the provisions of Article II, Section 15 of the Constitution, it is hereby declared to be the policy of Barangay Naba to take a proactive approach to preventive health care for infants and children. Towards this end, the Barangay shall adopt a comprehensive, mandatory, and sustainable immunization program for vaccine- preventable diseases for all infants and children.
SECTION II. PURPOSE. This Ordinance is enacted for the following purpose:
A. To build up herd immunity against vaccine- preventable diseases and eradicate their danger to mothers, children, and susceptible communities within the barangay.
B. To improve the immunization activities and overall health services at the Barangay Health Station.
l Monitor and evaluate immunization data and solicit feedback from citizens through barangay assemblies and barangay health board
l Ensure that funding is allocated for essential immunization programs by including them in the Barangay Annual Investment Plan, as recommended by the Barangay Health Board.
C. To provide the necessary equipment and support to meet the needs of healthcare workers in increasing Immunization achievements and lessen defaulter.
D. Promoting immunization demand by providing health education to citizens through various channels and empowering individuals to become Bakuna champions.
SECTION III. GOAL. The primary goal of this Ordinance is to have the Barangay Health Station, Infirmaries, Hospitals and other nutrition facilities within the barangay will continue to adopt and fully implement the National Immunization Program following the guidelines of the Department of Health, Municipal Health Office and other relevant laws.
SECTION IV. OBJECTIVES. The Ordinance aims to:
A. Safeguard the Health and well- being of the children from all forms of vaccine- preventable disease through the full implementation of the National Immunization Program in all Puroks.
B. Ensure that all parents, guardians, and stakeholders recognize the rights of every child to survival and full health training of health as an individual through full immunization.
C. Develop mechanisms for data analysis, micro- planning, barangay health plan, systematic program implementation, evaluation, and training of health workers to ensure the success of the immunization program.
ARTICLE IV
Definition of Terms
SECTION V. TECHNICAL TERMS. The Technical terms used in this Ordinance shall be defined as follows:
A. National Immunization Program (NIP)- an organizational component of the Center for Disease Control and Prevention, charged with preventing disease in children and adults.
B. Vaccine- Preventable Disease (VPD)- bacterial and viral diseases that can be prevented through immunization.
C. Immunization- the process whereby a person is made immune or resistant to an infectious disease by the administration of vaccine to stimulate the body’s immune system to protect the person against communicable infectious diseases.
D. Vaccine- a preparation used to render a person immune to some diseases by inducing or in the natural immunity mechanism. Such preparations usually contain organisms that attenuate virulence or are genetically engineered for the type for which immunity is desired.
E. Epidemic- applied to a disease, affecting a large number of individuals in a community, spreading widely, and attacking many person at the same time.
F. Epidemic Outbreak- the sudden occurrence of disease in a community where the disease is never experienced before, or when cases of disease occur in number greater that expected in a defined area.
G. Morbidity- the state of sickness or the rate of disease in a population.
H. Morbidity Rate- the proportion of death in a population.
I. Tuberculosis- an infection caused by mycobacterium tuberculosis which usually attack the lungs, but other parts of the body can also be affected including bones, joints, brains and pelvic organs.
J. Diphtheria- a bacterial infection caused by Corynecaterium Diphtheria, involving the mucus membrane, usually the tonsils and pharynx.
K. Tetanus- also know as lockjaw: casued by Clostridium Tetani Bacili present in neonatal morbidity and mortality if and when maternal protection with Tetanus Toxoid is low and when umbilical care practice are not followed.
L. Pertussis- also known as whooping cough; highly contagious, acute bacterial disease affecting the respiratory tract.
M. Poliomyelitis- a disease of the central nervous system caused by Type 1, 2 and 3 Polio Viruses.
N. Measles-a viral infections characterized by cough, coryza, or runny nose, or conjunctivitis, also with fever and rash, sometimes causing ear and brain infections.
O. Mumps- sometimes called infectious parotitis, is a viral infection primarily affecting the salivary glands, usually affecting children 5 to 9 years old.
P. Rubella- an infection n cause by a virus that can caused multiple fetal defects or congenital Rubella Syndrome when contracted in the first trimester of pregnancy.
Q. Hepatitis B- a viral infection of the liver. Acute infection either resolves or progresses or can become a chronic infection which can lead to liver cirrhosis or liver cancer.
R. Influenza- caused by a virus, mainly affecting respiratory tract usually lasting 3 to 7 days, manifested by colds, mild cough, muscle pains and body malaise.
S. COVID-19- a deadly viral infection affecting the respiratory system, especially the lungs.
ARTICLE V
Immunization Programs
SECTION VI. IMMUNIZATION PROGRAMS. In accordance with ARTICLE II, Section 15 of the Constitution, the Barangay Naba, Culasi, Antique plays an active role in providing preventive healthcare for infants, children, mother, and senior citizens. This includes implementing a comprehensive, mandatory, and sustainable immunization program for vaccine- preventable diseases. The program fully follows the guidelines of the Department of Health (DOH) and other relevant laws while implementing the National Immunization Program (NIP).
SECTION VII. REACHING EVERY PUROK. Shall be adopted as a strategy introduced by DOH as the next step after the Reaching Every Barangay(REB) to further strengthen the immunization system in the country by improving planning, managing available resources, service delivery and monitoring in the context of primary health care based on community needs. Specifically, it aims to provide equitable and sustainable access to vaccines for every age- eligible person, bridge immunity gaps among the disadvantaged puroks, blocks, or puroks in a barangay and reduce vaccine- preventable diseases (VPDs).
SECTION VIII. BARANGAY LOCAL HEALTH MANAGEMENT COUNCIL. A Barangay Local Health Management Council shall be created or activated with the following composition:

SECTION IX. DUTIES AND RESPONSIBILITIES. The Barangay Health Management Council (BLHMC) shall perform the following duties and responsibilities:
A. Actively participate in the planning, implementation, monitoring and evaluation of
Immunization and other health activities within the barangay through the MICRO-PLAN or Barangay Health Plan. The BHMC is scheduled to convene once every quarter to review and update the MICRO-PLAN or Barangay Health Plan.
B. Make sure that the BHWs and BNS are trained to check immunization data in their areas,
Find areas with low immunization rates, make plans for outreach, and work with barangay officials and partners to provide immunization services. They should also learn how to talk to mothers and caregivers during those visits and encourage them to have their children immunized regularly at the health center or during outreach services.
C. Improve service delivery by organizing safe and friendly immunization sessions that respect
cultural diversity and cover all eligible populations. Provide age- appropriate services for children, adolescents, adults, and senior citizens, ensuring adequate community health workers in every area. Implement innovative strategies for efficient immunization delivery.
D. Engaging with communities and increasing demand for services in health involve educating,
communicating, and mobilizing communities to willingly access immunization services. This includes effectively communicating the benefits and risks of vaccines, respecting cultural diversity, and involving potential community partners such as volunteers, advocates and non- traditional health partners.
E. Monitoring and use data for action to measure progress of the immunization program. Key
indicators are selected to monitor the process, performance, and quality of implementation. Tools are used to guide health workers in improving immunization coverage in low performing areas and sustaining gains in high performing areas.
SECTION X. VACCINATION CARD. Every infant/child below 5 years old must have vaccination card containing details of the vaccines received, doses and dates administered. The adult population who received immunization shall be given appropriated vaccination card.
SECTION XI. MAINTENANCE OF DATABASE. The Barangay Health Management Council (BHMC) through Secretariat shall keep and updated list of the population to ensure efficiency and availability of vaccines. A database of vaccination records shall be kept and updated regularly with adherence to data privacy law.
SECTION XII. EDUCATION AND INFORMATION CAMPAIGN. Local consultation shall be conducted to promote public awareness of vaccination programs to address issues and concerns that hinder vaccine acceptability. All healthcare practitioners or health care workers who are administering pre- natal care shall educate all pregnant women on the importance of giving their infants basic immunization services as well as modern procedures for immunization service as well as only possible effects of immunization. Appropriate information materials (IEC) shall be made available for distribution and dissemination to public.
SECTION XIII. OBLIGATION TO INFORM. Any Physician, Nurse, Midwife, Nursing Aid or Skilled Birth Attendant, who delivers or assists in the delivery of a newborn shall prior to delivery, inform parents or legal guardian of the newborn of the availability, nature, and benefits of immunization against vaccines- preventable disease at birth.
SECTION XIV. CONTINUING EDUCATION AND TRAINING OF HEALTH PERSONNEL AND SERVICE PROVIDERS. The Barangay Naba, Culasi, Antique shall undertake continuing information, education, and training programs for all concerned health personnel and service providers on the rationale and benefits of as well as modern procedures for immunization of infants and children against vaccine- preventable diseases. Roll- out training shall be conducted on basic knowledge as skills in vaccine administration, vaccine safety, risk communication, management and surveillance for adverse events following immunization.
ARTICLE VI
Appropriation
SECTION XV. BUDGET APPROPRIATION. The amount necessary to carry out the implementation of this Ordinance shall be included in the Barangay Annual Investment Plan of Barangay Naba, Culasi, Antique, specifically under the Budget Appropriation Item National Immunization Program (NIP) Activities starting at Twelve Thousand Pesos Only (Php 12,000.00) in 2025 of the Total Barangay Annual Budget of 2025 which shall have incremental increase annually as may determined necessary in consideration of the annual inflation rate, to cover various expenses but not limited to the following:
1. Logistics and supplies that has been identified in the Micro- Plan or Barangay Health Plan that is not covered by the supplies provided by DOH or the MHO.
2. Monitoring, supervision and evaluation activities to include travel, per diem and representation allowances.
3. Special/ Mass Vaccination Campaign expenses for meetings, seminars, orientation, special gatherings and related events.
4. Medicines for side effects and other related drugs.
5. Other expenses categorized as Barangay counterpart for Immunization Programs.
SECTION XVI. OTHER BUDGET SOURCE. In excess or under utilized budget from the Barangay Nutrition Activities or other activities related to health can be realign and appropriated to purpose of Immunization Program and activities.
ARTICLE VII
Miscellaneous Provisions
SECTION XVII. SEPARABILITY CLAUSE. If any provision of this Ordinance or the application of such provision to any person or circumstances is declared unconstitutional, the remainder of this Ordinance of the application of such provision to other person or circumstances shall not be affected by such declaration.
SECTION XVIII. REPEALING CLAUSE. All existing ordinances and resolution of this Barangay found to be inconsistent herewith are hereby repealed or modified accordingly.
SECTION XIX. EFFECTIVITY. This Ordinance shall take effect in accordance with the provisions of the Local Government Code of 1991. ENACTED AND APPROVED by the Sangguniang Barangay of Barangay Naba, Culasi, Antique on its session this ____________________, ________ at ______________.

WHEREAS, every barangay is committed to fostering a harmonious and peaceful community, particularly within Barangay Naba, Culasi, Antique;
WHEREAS, Republic Act No. 11926, Section 1, Article 155 of Act No. 3815 stipulates, "ART. 155. Alarms and Scandals," which entails the penalization of willful and indiscriminate disturbances;
WHEREAS, the imposition of curfews raises the debate regarding parental responsibility and the extent of the state's interest, as articulated in Senate Bill No. 2636, which defines "minors" as individuals under the age of 18;
WHEREAS, this ordinance is designed to address the issues concerning minors, who are frequently found engaging in the consumption of prohibited alcoholic beverages and this behavior has been linked to various adverse outcomes, including violence, sexual abuse, drug abuse, and suicides among Filipino youth, many of which stem from alcohol intoxication;
WHEREAS, there exists a pressing need to manage noise pollution within the barangay, necessitating restrictions on disturbances from 10:00 P.M. to 5:00 A.M. the following day.
NOW THEREFORE, BE IT RESOLVED, upon the motion of Hon. Ofelia O. Bandiola and duly seconded by Hon. Kennedy A. Gallego, this proposal has been unanimously approved by all members present in the Sangguniang Barangay session:
NOW THEREFORE, BE IT ORDAINED, the Sangguniang Barangay of Barangay Naba, Culasi, Antique, hereinafter referred to as the "Sangguniang Barangay," ordains as follows:
ARTICLE 1-TITLE.
Section I. TITLE: This ordinance shall be known as “ AN ORDINANCE REGULATING ALARMS
AND DISTURBANCES, AND ESTABLISHING CURFEW HOURS FOR MINORS BELOW 17 YEARS OF AGE FROM 9:00 P.M. TO 5:00 A.M. WITHIN BARANGAY NABA, CULASI, ANTIQUE, EXEMPTING BARANGAY FIESTA AND NEW YEAR'S CELEBRATIONS”
ARTICLE 2- COVERAGE.
Section II. COVERAGE. No individual shall engage in loud disturbances, challenge others to
physical confrontations, or provoke alarm and scandal. Additionally, the consumption of alcoholic beverages in public spaces is prohibited, as such actions may cause distress to nearby residents within the jurisdiction of Barangay Naba, Culasi, Antique.
ARTICLE 3- LEGAL BASIS, PURPOSE AND GOAL.
Section III. LEGAL BASIS. This ordinance is enacted to implement the provisions of Republic
Act No. 11926, Section 1, and Article 155 of Act No. 3815, which stipulates, "ART. 155. Alarms and Scandals," regarding the penalization of willful and indiscriminate disturbances.
Section IV. PURPOSE. The ordinance aims to:
4.1 Protect Minors and Prevent Crime. Curfews are set to keep minors indoors during late-night hours, reducing their risk of exposure to crime and violence. This helps prevent youth involvement in criminal activities and keeps the community safer.
4.2 Promote Peace and Order. Curfews assist law enforcement and barangay officials in managing youth loitering, which is often linked to vandalism and disturbances. They enable better monitoring and intervention during critical hours, boosting overall public safety.
4.3 Encourage Parental Responsibility. Curfew laws emphasize the role of parents in supervising their children. Some policies hold parents accountable if their minors violate curfews, promoting shared responsibility for child welfare.
4.4 Legal Authority and Fair Implementation. Local government units, including barangays, have the right under the Child and Youth Welfare Code to create curfew laws suited to their communities. These laws must protect minors’ rights while ensuring their safety. They should allow exceptions for legitimate activities, like school and church events, while restricting unsupervised loitering.
4.5 Supplementary Measures: Alarms can alert the community to curfew violations or suspicious activities involving minors, improving enforcement. Public reports of curfew violations act as deterrents, increasing vigilance and discouraging misbehavior among youth while fostering cooperation between families and barangay officials.
4.6 The goal of implementing curfews, alarms, and accountability measures in barangays is to create a safer environment for youths, reduce juvenile delinquency, promote discipline, and involve the community in child welfare. These actions enhance public safety and encourage responsible citizenship.
Section V. GOAL. The primary goal of implementing alarms, scandal control measures, and
curfews for minors within barangays are to enhance public safety, mitigate juvenile crime, promote discipline among youth, and reinforce community order and protection.
ARTICLE 4-PENAL PROVISIONS.
Section VI. PENALTIES. Violators of this ordinance shall be subjected to the following
penalties:
- 1st Offense: Php 500.00
- 2nd Offense: Php 750.00
- 3rd Offense: Php 1,000.00
Section VII. REPEALING CLAUSE: Any existing ordinances, rules, or regulations that conflict
with or are contrary to the provisions of this ordinance are hereby repealed, amended, or modified as necessary.
Section VIII. EFFECTIVITY: This ordinance shall become effective in accordance with the
provisions of the Local Government Code of 1991.
ENACTED AND APPROVED by the Sangguniang Barangay of Barangay Naba, Culasi, Antique, during its session on November 3, 2024, at 3:10 in the afternoon.
ORDER: A copy of this ordinance shall be provided to the Sangguniang Bayan for their review and appropriate action.
